The film (the term ‘film’ also includes the supporting details and metadata, wherever applicable) shall be between 3 & 15 minutes in duration. Films exceeding this time limit may be rejected. We recommend keeping the credits at the end of the film.
The films may be in their original language but MUST be subtitled in ENGLISH. We recommend subtitles be submitted in .srt format as far as possible and submit to us along with your film.
Films submitted previously to other competitions or used for other purposes will not be considered for this contest.
The films may be shot in any format. However, the recommended ratios are: 16:9 / 16:9 Full Height Anamorphic – in DV / HDV. The recommended video files formats are MP4.
In making your Film, you must have (1) obtained appropriate releases for every person who appears recognizably in your Film; (2) obtain appropriate releases for those locations that appear recognizably in your film and require releases; (3) obtained appropriate releases from producers, right-holders and/or co-producers You will retain any such releases and provide them to the organisers upon request.
The Film must not contain any copyrighted work(s) belonging to third parties unless (1) you have a license to use such works in the Film; or (2) the use your Film makes of such works is a fair one under the copyright laws. You will retain any licenses and provide them to organisers upon request.
The participant grants the Organisers (7racecoursefilms and Lokmat Media) the limited exclusive rights to screen (non – commercial) their film on their respective websites, at festivals and other associated screenings for the period of 3 years from the last date of submission, for which they are not entitled to any fee or consideration of any kind whatsoever.
The Participant also grants the Organisers the right to use their name, image, voice, likeness, statements, background in connection with the contest or ensuing events.
THE RIGHTS RELATING TO THE PARTICIPATING ENTRY
The IPR of the film will jointly belong to participant / film maker. Exclusive usage of the IPR as mentioned above will be with 7racecourse films.
The Participant, hereby represents and warrants as under:
The Participant is the rightful owner(s) of the film and/or have the absolute right and authority from the producers/right holders, to deal with the same, including participation in this contest by accepting the terms and conditions, in particular, the rights granted to 7racecoursefilms for distribution of the film as detailed hereinafter.
The Participant confirms that the content, in full or part, does not violate the copyright of any third party.
The Participant hereby confirms that they have not granted any rights nor will they grant any rights in the future relating to the participating film/entry/content which could adversely affect the rights granted to 7racecoursefilms for distribution of the said content
The Participant further indemnifies the organisers(called 7racecoursefilms & Lokmat Media Pvt. Ltd in the rest of the document) and holds it harmless if it incurs any loss, cost, or expense (including attorneys’ fees), due to any claim by self or any other parties relating to the content and / or their exploitation of the same.
The Participant also indemnifies the Organisers from any claims that may arise as a result of the breach of the terms and conditions of this contest by the Participant.
The Participants further confirm and agree to edit / modify the submitted film to the extent required by organises in the event organisers inform them of a potential copyright infringement / violation. The participant further agrees to provide all documentary proof and evidence with regards to the rightful ownership of the content as may be required by the organisers. The Participant further agrees and confirms to revert and resolve the aforesaid mentioned issues with 15 days of the same being raised by the organiser. In the event, the issues remain unresolved with the stipulated period, organisersreserves the right to distribute the film either by editing / modifying the same as it deems fit and/or in its original form at the risk and liability of the Participant.
By entering to this contest, the Participant hereby grants organisers an irrevocable and royalty free license to use and monetise the film, as well as your name, image, voice, likeness, statements, background and biographical material. These rights are granted exclusively to the organisersfor distribution and monetisation on internet and mobile platforms, known today or introduced in the future, including but not limited to organisersown mobile applications and internet website / portal.
The above mentioned rights are granted to organisersby the Participant for a lock-in period of 3 years from the date of this agreement and/or the submission of this film whichever is later. The agreement shall automatically be renewed for subsequent periods of 3 years unless either party expresses to the other its intent to terminate the agreement in writing, 30 days prior to the date of such renewals.
In the event the participant wants to terminate the agreement in the lock-in period or such extended period, the request may be considered by organisersat its discretion and on payment of a penalty equivalent to Rs. 25,000. Organisersmay also call upon the Participant to make payment of such penalty if the Participant does not comply with the requirements as stated here-in above.
The Participant also grants organisersexclusive rights to distribute and monetise the Film across all the platforms and mediums known today or may be introduced in the future. All rights are granted for worldwide territory.
To the extent permitted by law, each participant waives and releases organisersfrom any and all claims that participant may now or hereafter have in relation to moral rights or unfair competition with respect to Organisers exploitation of films without further notification to Participants of any kind. In the event that the waiver of moral rights as stipulated above is unenforceable or invalid, Participants hereby acknowledge and agree that Organisers are authorized to exercise all moral rights to the film, including but not limited to a right to publish, alter and adapt such film, and, where applicable, also to join such film(s) with other works and include such films into a collective work or database.
Copy, reproduce, adapt, translate, remake, make sequels, alter, rearrange, edit, cut, dub or subtitle in any language, and add to or delete from your film (including without limitation the right to extract audio only or picture only content from the film), in any way whatsoever, for the purpose of making and producing, advertising, promoting, publicising, broadcasting, exhibiting, distributing, exploiting and communicating to the public and to include the film (or any such altered or edited version of the film) whether as a single sequence or a series of sequences and preceded or followed by and interlaced with such other content (including without limitation any commercial breaks) as the organisers determine in its sole discretion;
Advertise, promote, publicise, broadcast, exhibit, distribute, monetise and exploit the film (and any clips from the film) or any such altered or edited version of the film, throughout the world in in all media and platforms and by any and all means now known or devised in future; and
Publish your film, or any part thereof, to the public via the organisers channels, including without limitation for promoting and redistributing part or all of the organisers websites in any media formats and through any media channels
The right to enter into agreements with any third party with regard to the exploitation, distribution and/or monetisation of the said rights of the film.
